Terms of Service

Version 1.0, in force from 22 June 2026

This is version 1.0. Dark Orb is operated by DanTodd Ltd on an interim basis while Dark Orb Ltd is being formed; these terms will be reissued under Dark Orb Ltd once it is registered. The liability and AI clauses remain under solicitor review and will be refined in a later version.

1. Who these terms are between

These terms are an agreement between you and DanTodd Ltd ("Dark Orb", "we", "us"), 1 St. Hilaire Walk, Leeds, England, LS10 4FE, company number 15749189. DanTodd Ltd operates Dark Orb on an interim basis while Dark Orb Ltd is being formed. By creating an account or using Dark Orb you agree to these terms. If you are using Dark Orb on behalf of a business, you confirm you are authorised to accept these terms for that business.

2. What Dark Orb is

Dark Orb is a business ecosystem. You describe what you want, and the service builds it for you. The first capability is building and hosting websites; more capabilities will follow. We describe current features honestly: where something is described as planned or in development, it is not yet available, and these terms apply only to the features actually provided to you.

3. Your account and sign-in

Sign-in is passwordless. You sign in with a passkey or a single-use magic link sent to your email. You are responsible for keeping access to your email account and your passkey device secure, since anyone with that access can sign in as you. Tell us promptly if you believe your account has been accessed without your permission. You must give accurate account information and keep it current.

4. Acceptable use

You agree not to use Dark Orb to create or distribute content that is illegal, that infringes others' intellectual property, that is hateful, harassing, deceptive (including phishing), malicious (including malware), or otherwise prohibited. You agree not to attempt to break, overload, reverse-engineer, or gain unauthorised access to the service or other users' data, and not to extract our system prompts or attempt to make the AI behave outside its intended use. A fuller Acceptable Use Policy is published as a separate document and forms part of these terms. We may suspend or remove content, or suspend or close an account, where we reasonably believe these rules have been broken.

5. Your content and who owns what

You own the content you provide and the websites you build with Dark Orb. To run the service (to store, process, compose, host, and display your sites), you grant us a licence to use that content for those purposes. This licence lasts as long as you use the service and ends when your content is deleted, except where we must retain copies briefly in backups or to meet a legal obligation.

We own Dark Orb itself: the orchestration system, the component and output libraries, the software, the brand, and everything we use to provide the service. Nothing in these terms transfers that to you. Stock images supplied through the service remain subject to their providers' licence terms. You are responsible for ensuring any content you upload, and any claims your published site makes, are accurate and lawful and that you have the rights to use them.

6. AI-composed output

Dark Orb uses AI to compose your sites. AI output can be wrong, incomplete, or unsuitable, and it is generated automatically without a human checking each result. You are responsible for reviewing what the service produces before you publish or rely on it, and for the accuracy and legality of anything you publish. We do not warrant that AI-composed output will be accurate, fit for a particular purpose, or free of errors.

7. Availability and changes to the service

We work to keep Dark Orb available and reliable, but we provide it "as is" and do not guarantee uninterrupted or error-free service. The service is evolving: we may add, change, or remove features. Where a change materially reduces a core part of the service you rely on, we will give reasonable notice where we can.

8. Fees

Dark Orb is currently provided without charge. If we introduce paid plans, we will publish the payment and subscription terms and give reasonable notice before any charge applies to you.

9. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, for loss of profit, revenue, data, or goodwill, or for content you or your visitors create or publish through the service. Because the service is currently provided without charge, and to the extent permitted by law, our total aggregate liability to you arising out of or in connection with the service is limited to one hundred pounds (£100); if and when you pay for the service, that limit will instead be the greater of £100 or the fees you paid us in the twelve months before the claim. As Dark Orb is a tool you direct, you are responsible for the sites you build and publish with it.

10. Suspension and termination

You can stop using Dark Orb and delete your account at any time. We may suspend or close your account if you break these terms or the Acceptable Use Policy, if required by law, or if continuing to provide the service to you would expose us or others to material risk. Where it is reasonable to do so, we will give notice. On account closure your content is deleted as described in the Privacy Policy, subject to short-lived backups and any legal retention obligation.

11. Changes to these terms

We may update these terms as the service grows. When we make a material change we will update the version below and, where appropriate, ask you to accept the updated terms before continuing. Minor corrections that do not change your rights or obligations do not require re-acceptance.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also have the protection of mandatory rules in your country of residence.

13. Contact
